TERMS & CONDITIONS OF USE

Upon ordering the services of Aurora Art & Design Pty Ltd, you the client agree to have read, understood and accepted the terms of use of Aurora Art & Design Pty Ltd. The below terms and conditions apply to logo design and corporate identity packages.

Design Orders and Cancellations

  1. In ordering the services of Aurora Art & Design Pty Ltd you agree to be legally bound by these Terms and Conditions. Please read these terms carefully. If you do not accept these Terms and Conditions stated here without modification, you may not use the Aurora Art & Design Pty Ltd service. Aurora Art & Design Pty Ltd is a design firm operating from a real physical location and is not an online logo design company; as such, Aurora Art & Design Pty Ltd works with its clients on a one on one basis via email and telephone conversation during a contracted project.
  2. Eligibility. To be able to qualify for the use of services of Aurora Art & Design Pty Ltd, the client must be 18 years and over, agree to these terms and conditions, and complete the design brief.
  3. Fees charged on a prepay basis are non-refundable.
  4. Once the design brief is submitted to Aurora Art & Design Pty Ltd, all design fees are payable in due course. No cancellations will be accepted once the design has been paid for and no refunds will be given.
  5. Refunds. Aurora Art & Design Pty Ltd is not responsible for the end product if the client is not satisfied after the project has been finalised and released; that is, if the client has already reviewed the samples provided and has decided to continue, finalise and approve a concept.
  6. If a client contravenes the Aurora Art & Design Pty Ltd terms and conditions, the service will be terminated immediately with no refund.

General

  1. Creative briefs. It is the client’s responsibility to send any creative briefs to Aurora Art & Design Pty Ltd (text, images and detailed descriptions must be provided). Aurora Art & Design Pty Ltd will provide the questions for the creative brief and the client will provide the answers to the brief via email in a timely fashion. Client cannot modify Aurora Art & Design Pty Ltd's creative brief in any way except to answer the provided questions.
  2. Aurora Art & Design Pty Ltd reserves the right to deny the production of artwork on receiving the creative brief, without payment.
  3. Ordering and Payments. Once a project has commenced, all concepts and final artwork will be emailed to the client. Project design shall not begin until full payment is received.
  4. Prices. All package prices are displayed in (AUD) Australian Dollars for design only. Printing is not included. All prices include GST.
  5. Outcome. Aurora Art & Design Pty Ltd will not be held responsible in any way for the loss of profit of a company. Aurora Art & Design Pty Ltd is not responsible for the project once it has been finalised and released. Where clients provide their own ideas and are not open to our designers' suggestions and recommendations, Aurora Art & Design Pty Ltd will not be responsible for the end result of the design.
  6. Concepts and Revisions. A concept is defined as a graphical representation of an idea in the form of a logo design. A revision is defined as a modification to a provided concept. A revision includes modifications including colour changes and positioning of graphical elements within that concept. Font changes are not generally accepted as a revision as fonts are an integral part of the overall logo concept and once changed can have a profound impact on the overall design integrity of that concept. Aurora Art & Design Pty Ltd's designers consider fonts very carefully during the design process and can only be changed if they deem that revision reasonable.
  7. Revision Cycles. Revision cycles consist of a number of times in which the artwork is sent to the client to review. Responses. Client agrees to provide timely responses to Aurora Art & Design Pty Ltd after receiving status notifications from Aurora Art & Design Pty Ltd. It is the client’s responsibility to maintain in contact with Aurora Art & Design Pty Ltd during the design process. The client shall have a maximum of 30 days (including weekends) to respond to each set of samples sent to them for review. If after 30 days the client fails to respond Aurora Art & Design Pty Ltd, it will be assumed that the production/project is complete. At such time Aurora Art & Design Pty Ltd shall have no further obligation to the client. Aurora Art & Design Pty Ltd shall not be held responsible for the condition of the artwork in the event of such circumstance.
  8. Production/Turnaround Time. Aurora Art & Design Pty Ltd specifies the time that it will take to finish the artwork in our invoice. If by any circumstance the process takes longer, Aurora Art & Design Pty Ltd will not be held responsible, as the client will be notified of the delay and will be given a reasonable date in which the artwork will be finished. Aurora Art & Design Pty Ltd provides estimated turnaround times for each logo design package however the actual time will depend on the client's speed of response to concepts and revisions. Turnaround time is calculated from the day that Aurora Art & Design Pty Ltd receives full payment for its services and all creative brief information and any images received.
  9. Special Offers and Discounts. Aurora Art & Design Pty Ltd can in its own right begin and end special offers at any time but will inform the client of a set date that their specific offer begins and ends.
  10. Copyright. Once a client has made full payment and approved and accepted their final design, they will own its Intellectual Property. Aurora Art & Design Pty Ltd shall not be held responsible for artwork produced for a company that may not be registered with resulting legal issues due to the business name. After the artwork has been produced Aurora Art & Design Pty Ltd shall not be binded to the company logo in any manner.
  11. If a client requests that a logo be designed in very specific way or to copy a logo the client has produced, Aurora Art & Design Pty Ltd shall not provide a style guide, even if the package includes a style guide. Aurora Art & Design Pty Ltd will not be held responsible if the logo was copied or is similar to another logo.
  12. Aurora Art & Design Pty Ltd cannot guarantee that a logo created by its designers will be absolutely unique (e.g. in the world). Aurora Art & Design Pty Ltd guarantees that its designers will attempt to design a unique logo compared to the client's company industry (e.g. for a mechanic, the automotive industry in Australia) not to all general logos. If a logo is similar to another logo in the industry it will be purely coincidental.
  13. Satisfaction Guarantee. A client may request additional concepts if they are not satisfied with the initial provided concepts and if no revisions have been requested for any of the initial concepts. The client must provide a detailed description of the elements that they are satisfied with and the elements that they are not satisfied with for each of the concepts. Additional concepts above the selected package concepts will be provided in lots of two and feedback must be provided on each occasion by the client. Revisions: Once a client has chosen a concept they are entitled to unlimited revisions on that concept (that is, only one concept out of all provided concepts can be revised). Stationery Design. One concept of the Stationery Design is provided and three revisions to that stationery is allowed (text changes only). After three revisions, a fee of $55 AUD inc GST will be charged for each additional revision to Stationery Design.
  14. Supplied Upgrades. Aurora Art & Design Pty Ltd assumes that anyone using our supplied Upgrades is proficient in the use of the software capable of opening the templates. Aurora Art & Design Pty Ltd takes no responsibility for how these templates behave in any given computer environment. Aurora Art & Design Pty Ltd does not offer technical support for any of our supplied templates including Word Documents, Power Point Presentations, Adobe Indesign files or Email Signatures. We strongly recommend our supplied Email Signatures be installed by a qualified IT professional.
  15. Aurora Art & Design Pty Ltd reserves the right to change its terms and conditions anytime without notice.
